At YADAhome.com, LLC ("YADAhome"), we respect your privacy. It is YADAhome's policy to take reasonable measures to help protect your privacy. By using or accessing the YADAhome.com website (sometimes referred to herein as the "Site"), mobile applications or mobile websites, or any services or features provided by YADAhome, its vendors or through the Site (collectively, "Services"), you are accepting the principles and practices described in this privacy policy.
YADAhome will respect the legal requirements that exist regarding the privacy of personal information and is committed to complying with all applicable laws regarding the privacy of personal information. YADAhome will, from time to time, review its personal information collection, use and disclosure practices in order to assure compliance with applicable laws and regulations.
What personal information we collect:
On some Site web pages, mobile applications or mobile websites, you can enter personal information. To register as a Site user, to join the YADAhome.com network, to register a YADAhome.com profile, to register a YADAhome.com Family Account, to access and use the Site and to take advantage of certain Services, it will be necessary to enter certain personal information. The types of personal information collected may include, without limitation, any or all of the following items: name, mailing address, city and/or state of residence, age, telephone number, email address, gender, birthdate, anniversaries, marital status, number of children, education and occupation, names and other information of family members, friends and/or other acquaintances (including, without limitation, their email addresses), passwords, login identifications (including passwords and login identifications for third party websites or networks in connection with the use of certain Services), credit card information (including, without limitation, account numbers and expiration dates), billing information, calendar entries, chores, tasks, grocery list entries, hobbies and interests, recipes, lifestyle choices, affiliations and contacts, schools and companies, pictures and videos, messages, journal entries and personal statements and any other personal information that you enter on, through or to the Site or in connection with any Services.
You will be required to pay one or more fees to YADAhome in order to access and take advantage of certain Services (e.g., the services and features of YADAhome Premium and the mobile services and features such as the iPhone application). Therefore, in order to access and take advantage of such Services you may be required to enter and store your (or your parent’s or legal guardian’s) credit card information on your profile and maintain a valid credit card account number on your profile at all times.
YADAhome may also collect personal information from you if you choose to participate in any Site activities or Services (such as sweepstakes, contests, surveys, questionnaires, recipe submissions, grocery lists, etc.), if you request us to furnish you with products, Services or information or if you invite others to join the YADAhome.com network or if you submit suggestions or content to us for our review or consideration.
If you choose to use our invitation service to tell a family member or other acquaintance about YADAhome.com, we will collect information needed to send the invitation, such as his or her email address. He or she may be sent emails or instant messages inviting him or her to visit YADAhome.com. We may use and store this information to send invitations and reminders, to register your acquaintance if the invitation is accepted, and to track the success of our referral program. He or she may contact us at [email protected] to request that we remove this information from our database.
We may also collect information about you from other sources (e.g., newspapers, blogs, instant messaging services, etc.) and other users of our Services through the operation of the Site or the Services (e.g., photo tags) in order to provide you with more useful information and a more personalized experience.
Except as provided in this privacy policy, we do not collect any personal information about you unless you directly or indirectly provide it to us. If you email us or answer questions we have placed on the Site, or otherwise enter information to, on or through any web pages on the Site, you are voluntarily releasing that information to us. Please do not submit personal information to us if you do not want us to have this information in our database.
How we use personal information:
YADAhome uses your personal information to register you as a YADAhome.com user, to allow for the set-up, maintenance and use of your YADAhome.com profile, to allow for your use of certain Services, to charge you for certain Services, and to better understand your needs and provide you with better products and services. We may also use your information to communicate back to you, to communicate with third party service providers in connection with certain Services, to invite others to join YADAhome.com, to update you on products, features, services and benefits (including, without limitation, coupons or advertisements) that we think may be of interest to you, to notify you of updates and contest winners, and to personalize our Site and Services for you.
YADAhome may share the personal information you provide online with other YADAhome divisions or affiliates and/or business partners or vendors associated with YADAhome, who are acting on our behalf or who offer products or services (including, without limitation, coupons or advertisements for products or services) that may be of interest to you, which may include transferring the personal information to other countries. YADAhome or its divisions, affiliates, business partners or vendors may use your information to contact you regarding such products or services, for market research or to provide you with marketing information we or they think may be of particular interest.
YADAhome will store your (or your parent’s or legal guardian’s) credit card information listed on your profile (including, without limitation, your (or your parent’s or legal guardian’s) credit card account number) and will transmit such information to its vendors for purposes of charging any and all applicable fees for Services.
In addition, your information may be provided to others permitted to view that information by your profile privacy settings. Information that you post on your profile may be available to Site users who belong to any of the networks you allow to access the information through your privacy settings. In some cases where your profile privacy settings permit it, other users may be able to supplement or modify your profile (e.g., shared calendars).
Further, if you registered a “Family Account” on or after August 14, 2013, you may elect to share your “login credentials” for this account (i.e. your family user name, your email address and your family password) with members of your “immediate family” (defined as your parents, spouse, siblings domiciled in your household, your children and persons over whom you maintain legal guardianship). You are solely responsible for controlling access to and maintaining the security and confidentiality of your username, family username and family password and for restricting access to any computer or device used to access your account. When you provide any persons with direct access (i.e. your “login credentials”) to your account, you have expressly granted those persons full access to your account content, and you have granted those persons express permission to make additions, deletions and alterations to any and all information related to or contained within your account, including your login credentials. You are fully responsible for the conduct of any persons you have permitted to access your account and those persons’ activity while using your account. You are fully responsible for the manner in which those persons use information contained within your account (which includes the safeguarding of any information contained within your account, your family user name, email address and family password). You are solely responsible for ensuring that those persons with whom you have shared your login credentials maintain the security of your login credentials and account content. You are solely responsible for ensuring that any individual who accesses your account reads and complies with our terms of use and have read and agree to our privacy agreement.
YADAhome may make a public member directory available to Site members. Entry into the directory is voluntary and you will be able to "opt-out" of the directly if you do not wish to participate. You will also be able to "opt-in" or "opt-out" of the directory at any time in the future by changing your privacy settings. If you elect to "opt-in" or otherwise participate in the member directory, your picture/avatar, name, city/state of residence and other biographical information may be displayed in the directory. In addition, the public member directory may also include a search function. If you elect to participate in the directory, any personal information that you have entered into the YADAhome.com database will be searchable by other users of the Site so that other users may search for you by querying such personal information. If you do not wish to participate in the directory or have your information searchable by other users through the directory, please ensure that you "opt-out" of the directory.
In addition, your name, network names and profile picture thumbnail may be available in other search results across the YADAhome.com network, and that information may also be made available to third party search engines.
When permitted or required by law or court order, YADAhome reserves the right to collect, use and/or disclose your personal information without giving notice, obtaining your consent or conducting related activities (for example, in connection with law enforcement investigations, to protect or defend the legal rights of YADAhome, and its affiliates, employees, agents, contractors, successors and assigns, to monitor your compliance with law and the Terms of Use in connection with your access to and use of the Site, to protect the safety and security of YADAhome, Site users and the general public and/or to protect against fraud or other illegal activity).
In the event of a sale, merger, liquidation, dissolution, reorganization or acquisition of YADAhome, or a YADAhome business unit, information that YADAhome has collected about you may be sold or otherwise transferred. However, this will only happen if the party acquiring the information agrees to be bound by the terms of the YADAhome privacy policy and the notice provided to you when the information was collected.
What aggregate information we collect:
We may also collect non-personal information and may aggregate any information collected in a manner (such as through the use of cookies and similar tools) which does not identify any specific individual. For example, when you enter the Site, we collect your browser type and IP address.
"Cookies" are pieces of information that may be placed on your computer by a website for the purpose of facilitating and enhancing your communication and interaction with that website. Many websites, including ours, use cookies for these purposes. You may stop or restrict the placement of cookies on your computer or flush them from your browser by adjusting your web browser preferences, in which case you may still use the Site, but it may interfere with some of its functionality.
As you use the Internet, a trail of electronic information is left at each website you visit through the use of items such as “pixel tags”. This information, which is sometimes referred to as "clickstream data", may be collected and stored by a website's server such as ours. Clickstream data and pixel tags can tell us the type of computer and browsing software you use, the address of the website from which you linked to the site and the number and types of views for a webpage.
How we use aggregate information:
We may use cookies to customize your visit to the Site and for other purposes to make your visit more convenient or to enable us to enhance our Services. We do not use cookies to retrieve personal information from your computer for purposes that are unrelated to the Site or the Services.
We may collect and use clickstream data as a form of aggregate information to anonymously determine how much time visitors spend on each page of our Site, how visitors navigate throughout the Site and how we may tailor our web pages to better meet the needs of visitors. We may use this information to improve our Site and our Services. Any collection or use of clickstream data will be anonymous and aggregate, and will not intentionally contain any personal information.
Your choice:
YADAhome will not use or share the information provided to us online in ways unrelated to the ones described above without letting you know and offering you a choice. We will also provide you the opportunity to let us know if you do not wish to receive unsolicited direct marketing materials from us, and we will make all reasonable efforts to honor such requests. We are not responsible for removing your information from the lists of any third party who has been provided your information in accordance with this policy, such as an affiliate or business partner.
Other Internet Sites/Third Party Advertising:
YADAhome Services and the Site may be linked to or share information with websites or services operated by third parties and the Site may contain advertisements from third parties.
Advertisements:
Third party advertisements that appear on the Site are sometimes sent directly to users. When this occurs, the third parties automatically receive your IP address. Third party websites and advertisements may also contain cookies or similar tools such as JavaScript and ”web beacons” to measure the effectiveness of their ads and to personalize advertising content. Therefore, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are selected or reviewed. YADAhome does not control the cookies or similar tools that may be used by third party advertisers even if such advertisements are placed on our Site. Third party advertisers will not have access to your personal information posted on your profile unless you choose to share it with them.
Synchronization and Information Sharing:
YADAhome may allow its members to synchronize and share certain data and information stored within their YADAhome account (including, but not limited to, data stored in their YADAhome calendar, YADAhome contact list, and YADAhome to-do list) with third party websites, systems and networks, including, but not limited to, Google, ICal, and MS Outlook (each a “Third Party Site”). If a YADAhome member wants to use this Service to share or synchronize information with a Third Party Site, the member will be required to store their Third Party Site credentials (e.g., login information and passwords) on the YADAhome server or on a YADAhome member’s mobile device under their YADAhome member account.
Sharing and synchronizing information between YADAhome and a Third Party Site involves increased risk that such information can be breached or otherwise compromised and, by agreeing to use this Service, YADAhome visitors and members acknowledge that they are using the Service at their own risk. The risks involved in using this Service may include, but are not limited to:
• information imported to or exported from YADAhome may be lost, corrupted, damaged, compromised, or misinterpreted by YADAhome or the Third Party Site;
• information may be unintentionally disclosed to users or members of YADAhome or the Third Party Site
• information exported from the YADAhome network may negatively impact the services offered by or information stored on the Third Party Site by interrupting or corrupting the Third Party Site’s processes or data;
• information imported from a Third Party Site may negatively impact the Services offered by or information stored on YADAhome’s network by interrupting YADAhome’s processes or data; and
• synchronization may impact the speed with which the YADAhome network, the Third Party Site or access to either occurs.
Synchronization and information sharing between YADAhome and a Third Party Site may occur automatically at intervals designated by YADAhome, manually by the member, upon the member’s logging into the member’s YADAhome account or upon the synchronization of a member’s mobile device with the member’s YADAhome account. YADAhome will not review or confirm any information that is imported from a member’s account with a Third Party Site to the user’s YADAhome account and/or exported from the member’s YADAhome account to the user’s account with a Third Party Site. YADAhome is not responsible for any unintended disclosure of information through the member’s YADAhome account or the member’s account with a Third Party Site (e.g., if information from a Third Party Site is imported to a member’s YADAhome account and as a result is disclosed to the member’s YADAhome network even though the member may not have intend to disclose such information to one or more persons in the member’s network).
YADAhome will use commercially reasonable efforts to safeguard each YADAhome members credentials to a Third Party Site but cannot ensure that such information will not be compromised. YADAhome shall not be responsible for a Third Party Site’s use or disclosure of any information that is exported from YADAhome. YADAhome shall not have any liability for the disclosure of information as a result of a member’s use of this Service and all such liability shall remain at all times with the member.
Information stored under each member’s YADAhome profile (such as to-do list entries, grocery lists, contacts, calendar entries, etc) may include information that the member has created and stored directly and/or information shared with the member through the member’s network with other YADAhome members. By using this Service, the YADAhome member acknowledges that information the member has entered, as well as information that has been shared with the member will be exported to the applicable Third Party Site. Members will at all times and with respect to all imported or exported information be responsible for adhering to the standards of conduct set forth in YADAhome’s Terms of Use and will not import any content that violates the Terms of Use or any applicable laws, rules or regulations.
By agreeing to use this Service, YADAhome members agree that they own or are otherwise entitled (i.e. members agree that they have the appropriate rights, title and/or license) to import to or export from the YADAhome database all applicable data and information. In the event that a member imports or exports any data or information that the member does not have sufficient right, title or license to, that is in violation of any other agreement, that is unlawful or that otherwise violates YADAhome’s Terms of Use or any applicable laws, rules or regulations, the member agrees to promptly notify YADAhome in writing and to promptly remove the data from YADAhome or the applicable Third Party Site, as applicable. Any breach of the foregoing may result in YADAhome immediately and permanently removing the member’s access to his or her YADAhome account and the access of any member with whom such information may have been shared. Each YADAhome member by using this Service also agrees to reimburse YADAhome for any cost associated with removing any such data from the YADAhome database and to defend and indemnify YADAhome against any lawsuit that arises in the event that the member imports or exports any data or information that violates any of the foregoing.
Policies and Practices of Third Parties:
In no event will YADAhome be responsible for the information collection or privacy practices of websites or other services operated or provided by other parties, even if such websites or services are linked to the Site. Once you exit the Site (e.g., via a link to the website or services offered by a third party), this privacy policy will not control such other websites or services and you should always consult the applicable privacy policy of such third party to determine how that third party will use any information they may collect from you.
Security:
YADAhome is committed to taking reasonable steps to ensure the security of your personal information and we have put in place certain procedures (for example, privacy settings for your “my fridge” profile and SSL encryption when registering for YADAhome.com) to help safeguard and secure the personal information we collect or you post online. However, YADAhome is not responsible for the unauthorized circumvention of any privacy settings or other security measures on our Site.
When you choose to post or transmit personal information to, on or through the Site (e.g., to your YADAhome.com “my fridge” profile and pages), you do so at your own risk. Even though we allow you to set privacy options that may limit access to your pages, no security measures are perfect. You can change and control your YADAhome.com profile by controlling the account settings available in the “edit profile” portion of your profile. However, YADAhome cannot control or constantly monitor the actions of other users with whom you have chosen to share your pages or information, and we do not guarantee that the personal information you choose to post or share will not be viewed or used by unauthorized users.
Whenever you voluntarily post public information to any public forums (e.g., journals, weblogs, blogs, message boards, classifieds, etc.) that information can be accessed by anyone and used for any purpose (for example, to send you unsolicited communications).
Collection of Information from Children:
YADAhome has no intention of collecting personal information from children under the age of thirteen (13) and does not knowingly collect personal information from children under the age of thirteen (13). If you are under the age of thirteen (13), do not attempt to register for YADAhome.com or submit any personal information to us. If a child under the age of thirteen (13) has provided YADAhome with personal information, YADAhome asks that a parent or guardian of the child contact YADAhome using our Contact Us page to inform us of that fact. Once contacted, YADAhome will use reasonable efforts to delete such information from our database.
Communications to Non-members:
Registered members of the Site can invite others to become a member by sending them an email invitation through our automated invitation system. YADAhome stores those email addresses so that the respondents may be added to the “my network” portion of the profile of the member sending the invitation, and to send reminders of the invitations. YADAhome does not sell these email addresses or use them to send any communications to non-members other than invitations and reminders. Recipients of invitations to join YADAhome.com may contact us using our Contact Us page to request the removal of their information from our database.
Registered Site members may also store email addresses of others in their “my fridge” profile address book and may choose to send invitations and other communications to those persons.
You may prevent YADAhome email invitations and other communications from YADAhome from being sent to any email address you control by sending a single email from that email address with the subject “BLOCK” to our email address set forth in our Contact Us page.
Non-confidential:
Any communication or material you post or otherwise contribute to, on or through the Site or any Services (including, without limitation, through any blogging feature of the Site) or you transmit to us by email or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, nonconfidential and nonproprietary. Except to the extent in contravention of this privacy policy, anything you transmit, contribute or post may be used by us for any purpose, including but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, you expressly agree that we are free to use any ideas, concepts, know-how, or techniques contained in any communication you transmit, contribute, post or otherwise send to us without compensation and for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products and services using such information.
Access to and Modification of Information:
YADAhome will maintain procedures consistent with applicable law for individuals to gain access to their collected personal information and, when appropriate, correct any information that is inaccurate or incomplete, change their individual consent level, or have their personal information deleted. If you would like to review, correct, modify, remove or delete your personal information, you can modify your profile using the “edit profile” portion of your profile to make certain modifications or you can contact us using our Contact Us page. However, certain information (e.g., a personal message sent to another user) generally cannot be removed. Please note that even following removal, copies of personal information may remain viewable in cached and archived pages or if others have copied or stored your information.

United States of America:
The Site is maintained in the United States of America. By accessing or using the Site and any Services, you authorize the export and transfer of your personal information to the USA and its storage, processing and use in the USA as specified in this policy. If you are located in a country other than the USA (e.g., in the European Union) and you choose to provide us with personal information, you are responsible for ensuring that such information complies with all local data protection laws (e.g., EU local data protection laws). YADAhome is not responsible under such laws for the information that you may provide to, on or through the Site or any Services.
Consent; Changes to Privacy Policy:
By accessing or using the Site and any Services, you consent to our use of your personal information as specified in this privacy policy. YADAhome may, and reserves the right to, modify and update this privacy policy or its related business practices at any time, including, without limitation, to reflect industry practices and to comply with changes in law, with or without notice to you. Any such changes will be effective upon posting to the Site or on such other date as may be specified in the modified privacy policy, so we encourage you to review this privacy policy frequently. Your continued access to or use of the Site or any Services after a posted change to the privacy policy signifies your acceptance of the modified privacy policy.
